Terms of Service

These Terms of Service govern your use of Aviation Culinary Network to discover caterers and place catering orders. Please read them carefully.

1. Agreement to these Terms

These Terms of Service (the “Terms”) are a binding agreement between you and ACN Holdings LLC, doing business as Aviation Culinary Network (“ACN,” “we,” “us,” or “our”), operator of the Aviation Culinary Network platform at www.aviationculinarynetwork.com (the “Platform”). By accessing the Platform, placing an order, or creating an account, you agree to these Terms. If you do not agree, do not use the Platform.

2. What ACN is

ACN is an online marketplace that connects flight crews, operators, and other buyers (“Buyers,” “you”) with independent third-party catering providers (“Caterers”). ACN facilitates discovery, ordering, payment processing, and order tracking. ACN does not prepare, cook, package, or deliver food. The Caterer is solely responsible for preparing and delivering each order and is the seller of the food and services. ACN is not a party to the food-service transaction except as a limited payment collection agent and platform provider.

3. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Platform. You may order as a guest or create an account. You are responsible for the accuracy of the information you provide and for any activity under your account. Account authentication is provided by our identity vendor; keep your credentials secure.

4. Placing an order

When you submit an order you are making an offer to purchase from the selected Caterer. A binding order is formed only when the Caterer accepts it. Each order is assigned a unique reference number (for example, ACN-100000-1, where the trailing digit is the revision). You are responsible for providing accurate flight and delivery details, including airport, FBO, tail number, passenger count, delivery date, and delivery time. Delivery times are stated in Zulu (UTC). A Caterer may decline an order (for example, for capacity, lead time, or service-area reasons); if declined, you will not be charged, or any authorization will be released or refunded.

5. Pricing, fees, and payment

  • Menu prices and any delivery fees are set by the Caterer and shown before checkout.
  • ACN charges a service fee of 10%, added to your order total at checkout.
  • Payment is processed by our third-party payment processor (Stripe). Your card is charged or authorized at checkout. ACN does not store full payment card numbers.
  • The Caterer is paid for the food and delivery total after delivery is confirmed; ACN retains the service fee for operating the Platform.
  • Applicable taxes may be added as required by law. You are responsible for any taxes not collected at checkout where required.

6. Changes and revisions

Orders may be revised up to 12 hours before the scheduled delivery time, after which the order locks so the kitchen can execute reliably. Each revision increments the order’s revision number, and the Caterer is notified. Inside the lock window, contact ACN and we will make reasonable efforts to accommodate changes at our and the Caterer’s discretion. Price differences from a revision may be charged or refunded.

7. Cancellations and refunds

Because catering is prepared to order and is perishable, cancellations are subject to the timing of your request and the Caterer’s lead time. Cancellations before the Caterer begins preparation are generally eligible for a refund of the food total; once preparation has begun or inside the lock window, refunds may not be available. If an order is not delivered or materially fails to conform to what was ordered, report it through the Platform and ACN will review the matter, hold the affected payout, and work in good faith toward a fair resolution, which may include a partial or full refund.

8. Delivery

Caterers deliver to the FBO or aircraft location you specify. Accurate flight details and timely access are your responsibility. Title and risk of loss for the food pass upon delivery to the specified location or recipient. Crews are responsible for proper onboard handling, storage, and any reheating after delivery.

9. Food allergies, dietary needs, and safety

You must clearly communicate allergies and dietary restrictions when ordering. While Caterers are expected to take reasonable care, ACN and Caterers cannot guarantee that any food is free from allergens or prepared in an allergen-free environment, and cross-contact may occur. You assume the risks associated with food allergies and dietary restrictions. If you have a severe allergy, do not rely solely on the Platform.

10. Quality and standards

ACN promotes the Aviation Culinary Standard (ACS) as a quality and execution benchmark, but each Caterer is independently responsible for its food and service. If an order falls short, report it through the Platform so we can review it and, where appropriate, hold payment pending resolution.

11. Acceptable use

You agree not to misuse the Platform, including by submitting false information, placing fraudulent orders, interfering with the Platform’s operation, or using it for any unlawful purpose.

12. Disclaimers

The Platform and all content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. ACN does not warrant that the Platform will be uninterrupted or error-free, or warrant the food, acts, or omissions of any Caterer.

13. Limitation of liability

To the maximum extent permitted by law, ACN and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of or related to your use of the Platform or any order. ACN’s total liability for any claim relating to an order will not exceed the ACN service fee actually received by ACN for that order. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless ACN from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Platform or your violation of these Terms or applicable law.

15. Governing law and disputes

These Terms are governed by the laws of the State of Montana, without regard to its conflict-of-laws rules. The state and federal courts located in Montana will have exclusive jurisdiction over disputes arising from these Terms, unless a separate arbitration agreement applies.

16. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the effective date above, and your continued use of the Platform after changes take effect constitutes acceptance.
